本港未成年人性交易非法化、重罪化

業前，中華人民共和國香港特別行政區政府仍以16週歲為從事性交易的合法入門年齡。任何以威逼利誘方式同未滿16週歲的未成年少男少女發生性關係的，頂格僅處十年徒刑；以這類方式和滿16週歲而未滿18週歲的人發生性關係的，則更可能不受到任何政府處罰。

本港歷來以法治聞名。可如果沒有能保護人權的良法，豈能說是法治呢？縱觀世界上和香港地位相當的都市、城市，內地皆已將性交易入刑、欲和未成年人發生關係更可能被判終生監禁。在美國，成年人和未成年人發生性關係的，在多州也被列入"強制猥褻"的重罪中。

19年運動、新冠疫情對香港經濟社會運行造成衝擊，香港走入了壓力空前巨大的時代。在這時候，未成年人通過網路等各種途徑進行援交、性交易的情況屢見不鮮。我們呼籲港府承擔起作為負責任政府應有的擔當，對任何試圖以金錢交易的手段來損害未成年人健康和尊嚴的人進行打擊。保護未成年人，不止是使我們在今天能驕傲地在世界上抬頭，更是使我們在明天仍能重振香港的榮光。

Currently, the Government of the Hong Kong Special Administrative Region of the People's Republic of China maintains the age of 16 as the legal age of entry into the sex industry. Anyone who has sex with a minor under the age of 16 by coercion or inducement is liable to a maximum penalty of only 10 years' imprisonment, while those who have sex with a person over the age of 16 but under the age of 18 in such a manner are even more likely to be exempted from any governmental penalties.

Hong Kong has always been known for its rule of law. But how can it be the rule of law if there are no good laws to protect human rights? If we look at mega and metropolises in the world that are comparable to Hong Kong, we will find that the most of them had done better than us. Mainland China has criminalized sex trade, and that people who have sex with minors are liable to be sentenced to life imprisonment. In the United States, sexual relations between adults and minors are included in the felony of "compulsory indecency" in many states.

The Movement in 2019 and the Covid pandemic have had an impact on Hong Kong's economic and social operations, and Hong Kong has entered an era of unprecedented pressure. At this time, it is not uncommon to see minors engaging in "compensated dating" and sex trafficking through various channels such as the Internet. We call on the Hong Kong government to take up its due responsibility as a responsible government and crack down on anyone who tries to jeopardize the health and dignity of minors by means of monetary transactions. Protecting minors will not only enable us to proudly hold our head in the world today, but will also enable us to revive the glory of Hong Kong tomorrow.
